The advices from our learned friends Miss Archana and Kiran Kumar are very good and accoriding to law where as I dont agree with sashikumar. 

My advice is not to delay filing the eviction petiion.  You have a very nice chance to win.  But be on the look aout for the delay in court. The tenant will adop all sorts of delaying tactics. Ultimatly you will win.  But be prepared for delay.
