suspension and reinstatement

what will be the service status of employee, if an employee for criminal offence placed under judicial custody(jail)upon conviction, suspended by employer after one year with retrospective effect, not paid subsistence to family, released by court on bail after 11 yrs, crl appeal pending, no departmental disciplinary action initiated by employer.....Is he entitle for reinstatement)back wage due fault of employee in non adherence of procedures. Request expert opinion based on central govt rule

A convicted employee who was imprisoned for 11 years has by default lost his job if he was in the government job. He will get the subsistence allowance provided he was in service and under suspension.
