If there is settled rule to JEE to consider the current year exam marks only'the court will not interfere in the matter.So pl.find out the JEE rule.

Current ranking shall be considered.

THANKS SIR, PERHAPS , IF YOU MAY REMEBER LAST YEAR CASE .IN WHICH A STUDENT IN JOSSA PORTAL ,RATHER TO ACCEPT A SEAT -HE OPTED TO EXIT. HE APPEALED IN S.C BUT TILL DATE , ALL ADMISSIONS WERE CLOSED . S.C. DIRECTED TO IIT ,BOMBAY TO CREATE ADDITIONAL SEAT AND ALLOT HIM.

JEE GIVES 2ND OPPORTUBITY TO IMPROVE PERFORMANCE. YES ,IT IS TRUE THAT JEE CONSDERS CURRENT RANKING BUT DOES NOT SAY THAT -LAST YEAR PERFORMANCE HAS GONE IN DUSTBIN. THE EXAM HALL RECORD SHOW THAT STUDENT COULD NOT SIT FOR 3 HRS IN SEAT .THE LAW DOESNT LIKE TO PUNISH BY TIME AND BY TIME ITSELF.COURT MAY CONSIDER THAT LAW RULE IS MAKING PUNISHMENT ONLY.

As per your concern, let me inform you that every ruling of a court of law varies from others and is based upon the discretion of the court and reasonable understanding of the judges regarding the issues and facts of the case.
Henceforth, you should not formulate an opinion regarding your matter. Since, the JEE has its rules and regulations laid down crystal clear there are a number of reasons upon which the court might dismiss the writ petition.

Moreover, it is very important for everyone to understand that 'when opportunities knock, one should take them as they might not knock again'. This incident will surely be a life lesson for the candidate.
