Can amend a prayer adding subsequent event to change prayer

A muslim male filed a suit for divorce against his wife. Now coming to know that family court has no jurisdiction to grant divorce he sent a talak notice to wife. And he subsequently filed an amendment petition in suit to declare the talak as valid
