loan recovery from lunatic person

after contract has been done of 1crore Now he is acting to suffer amnesia so how bank can recover the loan from the person and under which section?

In the given facts, not only documents pertaining to bank loan should be brought in evidence against such person but he should also be requested to be referred to a medical board for the purpose of certifying whether he is acutally suffering from the said illness or is making excuse.

 

There is no requirement of law to have acceptance of the claim of the plaintiff from the defendant. Every defendant taakes various defence to frusterate the claim of the plaintiff so plaintiff has to stand upon his own legs. Nothing to worry in the present case.
