प्रार्थी ने भ्रमवश विलम्ब क्षमा प्रार्थनापत्र 65 दिनों के अपवर्जन हेतु धारा 5 , परिसीमन अधिनियम के तहत देते हुये अपील किया था । उक्त वाद के तथ्यों के आधार परिसीमन अधिनियमकी धारा 12 केअनुसार गणना करने पर कोई विलम्ब नही है ।
प्रा0पत्र धारा 5 के अन्तर्गत निरस्त कर दिया गया है ।
प्रश्न :- क्या उपरोक्त्त निरस्तीकरण के कारण मूल अपील भी निरस्त मानी जायेगी?

Dear sir, Thanks for reply.The rejection was on the following basis :-
" ......उपरोक्त समस्त तथ्यों के आधार पर मैं इस मत का हूँकि अपील को आयोजित करने में हुये विलम्ब को क्षमा किये जाने हेतु प्रकट कारण प्रयाप्त नही हैं एंव अपील काल बधित है। तद्नुसार प्रार्थी द्वारा प्रस्तुत आवेदन पत्र निरस्त किये जाने योग्य है ।
आदेश
प्रार्थी द्वारा प्रस्तुत आवेदन पत्र धारा 5 परिसीमनअधिनियमनिरस्त किया जाता है । पत्रावली दाखिल अभिलेखागार हो।
Q. whether a petition u/s 151 of C.P.C. can be filed before the higher court I.e. Hon'ble District Court ?

The application for condonation of 65 days (each day's)  delay has to be explained / justified by your lawyer. 

What is the opinion and advise of the lawyer engaged / paid by you, who is well aware about the facts and circumstances of the case, an bale, competent and intelligent enough to satisfy your query, if it is not an examination hall question paper.

Even if you feel strong to have a second opinion it is advisable to consult another local prudent lawyer for better appreciation of facts/ documents, professional advise and necessary proceeding.

You may have to convince the court the reasons for delay  in preferring this case.

The court if satisfied and convinced with the reason justified by you then it may allow the petition.
