husband file divorce case from his hometown

hi,
me and my my husband lived in chandigarh,but he is from bihar, and he filed a divorce petition from his hometown, we never lived together in bihar, our last stay in chandigarh which is in this year,2019. please advise .is he has right to file divorce case from his hometown,where we never lived together.

He can file. If you feeel aggrieved you can file a suit for restitution of conjugal rights.Besides file an application under section 125 Cr pc For mainetanance  and keep often and short dates and that would make him to come on table.\

You file suit in Chandigarh against him for maintenance etc etc and teach him lesson

Consult a local prudent lawyer for assistance. It is always advisable to see pros n cons before action. If matter can be resolved amicably , first go for it otherwise lawyer service you can opt.

only bonafide cases should be filed in Court and no case should be filed "to teach him a lesson" ..

false cases are punishable as perjury and may also attract contempt of court .. then who will get to learn lesson ..?

the queriest asked a pure legal query and not how to use law to pressurise her husband and to bring on negotiation table .. what for ..? this can rupture even the remaining bond of marriage .. effort should first be made to protect the marriage

I suggest the queries should first decide if she wants divorce or she wants the marriage to continue and accordingly take the steps .. if you want divorce then it is not advisable to waste time.. try to arrive at an amicable solution with the help of elders and advocates of both sides

Find out some amicable solution to your dispute(s) before seeking legal remedy.

Did you receive any summons/notice from concerned Court ? If so, engage a local prudent lawyer to find way out.

No one can stop him or you to move to any Court, however, while contesting the case it is your lawyer to take care of such issue.

Where was the marriage solemnised? Such petition could be filed in the Distrct (Family) Court where the marriage was solemnised or where the couple are residng or lat resided together. Anyhow, you can approach Supreme Court to transfer the petition to Chandigarh.
