An application was moved by the complainants lawyer which did not have the complainants signature. The court started the proceedings but when we came to know that the applicant was not in india and is away for past 2 yrs pluss the application has allegations which are fit case for perjury 340. we applied for certified copy of the application wether it has any power of attorney or what.
Now the certified copy doesnot have any signature of the applicant but the lawyer has signed.
What action can be taken? what crpc section can be applied here.
also can perjury be applied as court has taken it on record
