Recovery of pending dues

Our company faced a financial crisis in 2014 and since then salaries were irregular. The same year workers and junior staff were paid bonus for year 2013-2014 but the middle / executive staff wasn't paid for bonus. Some of the middle management executies were being paid incentives and the same was also not paid.

Salaries remained irregular in 2015 and since December 2015 the situaton got to worse. Starting March 2016 wwwwwe started to protest against the same and were paid now and then for a month in three or four or 15 days or so.

The current situation is like many of us left the organisation by giving proper resignation and few didn't resigned.

Apart from salaries the PF, ESI, TDS etc. hasn't been deposited for almost one and a half year or more. PF department and ESi have also issued recovery notices to the firm. Labours have already filed case in District Labour Court and were being paid as per DLC's orders.

Our concern is

Should we proceed for legal action against the employer as we've also got news that one of the vendor is filing a case in NCLT against the company. And in arrecent developement DLC also ordered lockdown of the firm.

We are really puzelled how to tackle the situation. IF any body could please guide us to recover our dues we'll be highly obliged.
