Booking amount builder not refund

My Sister Husband Book 3BHK Row House in 2012 at Aurangabad & he gave 5.5 lakh rs to builder by cash. afer 5 month he pass away .
so my sister is not capable to purchase this Row house .
we request to builder many time about 5.5 lakh refund but he say when new customer purchase this row house then I will give your money.
sister having only cash receipt of 5 lakh.
what can we do??
please help us.

Dear querist,

You may send notice to the builder for recovery of money and if he does not do so, then may file civil suit for recovery of money.

we have only booking receipt with 1 rs revenue stamp.
and this receipt not having date

now you can lodge complaint against builder online in RERA act meanwhile your sister should obtain sucession certificate from court on accout of husband death
