Can hc order u/s 24, hma be challenged bef hc div bench

Hello :

Can a High Court Order by a Single Judge under Sec. 24 in Hindu Marriage Act (maintenance pendente lite) be challenged before the Division Bench of the same HC ? This is for Gujarat, FYI.

No.

100A. No further appeal in certain cases— Notwithstanding anything contained in any Letters Patent for any High Court or in any other instrument having the force of law or in any other law for the time being in 30 force, where any appeal from an appellate decree or order is heard and decided by a single Judge of a High Court, no further appeal shall lie from the judgment, decision or order or such single Judge in such appeal or from any decree passed in such appeal.]

So is there any other way, apart from LPA, to approach the Division Bench of the HC ?

Or, can we only move to the SC in this case ?

There are so many factors to be considered and in your case the facts of the said case are not clear .(both of the lower court as well as the High Court).

Going by what you stated ypu can file at yhe Supreme court.
