RAKHI BUDHIRAJA ADVOCATE (LAWYER AT BUDHIRAJA & ASSOCIATES SUPREME COURT OF INDIA)     02 June 2010

Thanx for the information.

YOGESHWAR. (ADVOCATE HIGH COURT-criminal /civil -youract@gmail.com)     03 June 2010

Dear sir, thanks for effort but this is the situation when the accused accepts the claim. With due respect to all the learned contributors we are of the firm opinion that the illegal money loan sharks should not be allowed to take any advantage of NI 138 provisons.

The unauthorised money lenders add huge interest since they take blank cheques and than take advantage  of legal system to recover it.

But in the process they make mistakes and with due delligence its benefit must be provided to the accused.

We will assist the accused to come out of the clutches of the money lenders but you have to be vigilant at trial stage. If at higher stage you want to contest there are very very less possibilites.
