Muslim restitution of conjugal rights

Dear friends, Namaskar. Both parties Muslim. Husband want to file restitution of conjugal rights. under which act, section we have to file a case for restitution of conjugal rights. Whether we to file a suit in the family court or district court . Please clarify, Sir.

Hi! Thanks for the question!

Section 9 of Hindu Marriage Act, 1955 (HMA) provides for restitution of conjugal rights (RCR). The application can be moved in Family Court, established for the matrimonial matters specially! Go through this link for better clarification of things!
