Bipin Kumar Agarwal (Practising C.A)     17 April 2018

Notice period

I mailed to my HR and Manager Below:-

As discussed with you , I will unable  to continue  my  services with XXX Private Limited. I am hereby tendering my resignation and humble request you to release me upto 30th April,2018 or before that.

Thank you for your great support and guidance  which will surely benefit me in my future.

As per my appointment letter I have to give notice for 30 days.

Now  my manger he told me i have to serve 2 month in company and before that he will not release me and I told him as per company policy I will serve only 30 days beacuse my next company would like to join me as early as possible.

My Qyestion:-

1) Whther contention of my manger for 2 month notice is correct.

2) What should I do?

( For you reference appointment letter attached- fisrt 2 page salary bifuracation so not attached).

1) You'll only be governed by what's written in the agreement, but as per the whims and fancies of the HR.
2) You'll have to serve a legal notice to your employer stating your grievance.

I wrote "but" instead of "not" in the first paragraph. Sorry for the typographical error.

GO THROUGH THE STANDING ORDERS OF YOUR COMPANY FIRST . SURE YOU WILL GET THE WAY TO FORWARD IT FROM SAID ORDERS.
