Remove co-buyer from agreement of sale document

Hello All,

      I have a small matter regarding an agreement of sale to buy a parcel of land. Me and another person (not related to me as family) , had entered together into an agreement with the seller to purchase the said land. The agreement is on a 200Rs bond paper, is not registered, and There was no division of area mentioned and we both were treated as the second party. Now we had to pay 25% of agreement value at time of signing, my cheques have cleared while his cheques have not . Now that person is unable to raise the money . I wish to completely buy the property myself. What should be done to the current agreement of sale (It is with me by the way).

Kindly shed some light on how to proceed.

Seller can make sale in your favour after terminating the agreement of second person. Mere signing agreement does not constitute any agreement if consideration is missing.
