Justice to married men

Respected Legal Counsels,

If a married man commits injustice to his wife, she has a lot of legal recourse and the person is brought to justice in favour of the women, which is very much appreciable.  However, if a married women with false allegations brings her husband to court, dragging the case for many years and at the end (after 10 or more years) if the husband proves not guilty, there is no punishment to the women.  I have not see, however, please correct me if I am wrong.

Why not our judicial authorities consider by taking stringent action and punish the ill-motivated wife by putting them at least 1 to 2 years behind the bars for those who have falsely alleged and wasted the man's life, respect in society, money, restless in his office work and honourable courts' precious time.

To take up this issue, who will be competent authority the innocent men can put their plea so that the sacred marriage is saved.  This request is from a Hindu born person.

If the intent is save the marriage it is between both spouses.

They can adjust to each other and save the marriage.

The purpose of opportunity of mediation is also to save the marriage.

It is true that there are several authorities to render so called help to woman and there are more than 90 per cent cases where woman has misused the law. Now Supreme Court has laid several reformative laws. There are laws for laws to protect man but the ways are to be used strategically. After discharge man can file defamation case both civil and criminal and also for suit for damages etc.

Numerous people, especially young and energetic boys, have committed suicide and many aged parents are suffering in this country because of misuse of Women Protection Laws. Men's fundamental rights given by the constitution should be safeguarded. The women filing false cases misusing these laws for purely extorting money and fulfilling their unfair demands should be severely punished with both imprisonment and fine if their cases are proved as false by their husbands. At present, many such false cases, if proved as false, are simply dismissed without any punishment which is the main cause for encouraging lot of women to file false cases for harassing their husbands and in-laws to fulfill their unfair demands. The gender-biased Laws must be suitably amended by the Central Government of India to prevent filing false cases by unscrupulous women.

 

I have written many letters to the Prime Minister, Home Minister,  SC, HC, Ministry of law and Justice etc several times in this regrd but the situation remain the same without taking any fruitful action.

What is justice for you may not necessarily be justice for someone else. Same logic applies to courts. You think you will get justice and aproach courts.

But what is finally served on your plate as JUSTIcE may not be really justice in your eyes.

Finally whatever they serve on your plate is justice.

If you want married life, you should sacrifice your life.  If you cant adjust better not marry.  If you are already married easy way out is take divorce.

Suicide is not an answer but another headache to people who are left behind.

Hope you understand this simple but complex thing.

What we need to Emphasize here is that the law must be equal to all genders and it should not be gender-biased and we do not seek advice whether to get married or remain unmarried and if married to sacrifice life accepting all unfair and unacceptable demands nor definition of justice. What we are talking here is about misuse of such gender-biased laws and filing false cases.

The Women Protaction Laws are meant for redressal/benefits of really suffering women which are welcome, but they are mostly misused by unscrupulous women and their parents in this country for fulfilling their unfair demands and for extorting huge amounts of money, from their husbands and in-laws harassing them using these laws as weapons. We have to stop this Legal Terrorism immediately.

You can say that false cases will result in acquital of respondents when justice is given in the plate. But when such justice is given in the plae? It is given after many years. Till then how much harassment, mental agony, sufferings, travels, spending money, wasting time etc have to be undergone by the respondents? The fact that only 2 to 3 % of such cases only have resulted in conviction itself shows that how much precious time of Hon'ble Courts has been wasted all over the country in dealing with the remaining 97 to 98% of the cases. These are the reasons why we are telling that such Laws must be suitably amended to prevent false filing.

We are not asking to punish such false filing women if they can not prove their allegations, but we are asking to punish them only when their allegations are proved as false by the respondents. If such cases are genuine, how and why only 2 to 3% of cases only result in convictuion? The percentage of conviction should be much more if really women file genuine cases. The law should take care that women having genuine allegations only should come forward to file petitions and discourage women filing false cases taking as a sort of weapon and do Legal Terrorism.

The sufferrer, instead of resorting to torment his/her personal life and also of relatives must endeavor to get irrefutable evidences to get justice.
