The Indian Stamp Act, 1899 nowhere prescribes any expiry date for use of a stamp paper. Section 54 merely provides that a person possessing a stamp paper for which he has no immediate use (which is not spoiled or rendered unfit or useless), can seek refund of the value thereof by surrendering such stamp paper to the Collector provided it was purchased within the period of six months next preceding the date on which it was so surrendered.

 

The stipulation of the period of six months prescribed in section 54 is only for the purpose of seeking refund of the value of the unused stamp paper, and not for use of the stamp paper. Section 54 does not require the person who has purchased a stamp paper, to use it within six months. Therefore, there is no impediment for a stamp paper purchased more than six months prior to theproposed date of execution, being used for a document.

There is no six month prescribed anywhere. It is valid for its life. Use of old stamp paper for current transaction can at the best only cast a doubt about its genuines and cannot invalidate the stamp paper.

I want to know If one sign  by mistake( unknowingly) on stamp paper.How He can prevent it from misusing it.

Let say  some one has taken signature on stamp paper then what its validity in court .

Is there is any way to correct the  tems and condition if one has signned on stamp paper by mistake.

six month is provided for getting refund only. no where there is any provision imposing limitation on the use of stamp paper.

 The validity of the Stamp Paper, in as far as Maharashtra is concerned is SIX MONTHS only. A specific provision invalidating the stamps which have been purchased but have not been used or in respect of which no allowance has been claimed within 6 months has been insered as Section 52B by Mah.18 of 1989, s.8(w.e.f.12.1989). This position is also already clarified in relation to previous queries and also in an expert's article in the Forum. Would request the queriest and also the fellow members to check this out, by search mode.

A Stamp Paper is just like a currency note, which has no maximum validity period.....the Stamp Duty may increase/ decrease, which may , then , require the purchase of additional Stamp Papers, but , in any case, the Stamp Papers howsoever old, may be used at any time.......

In this regard, the judgment of the Hon'ble Apex Court  reported in AIR2008SC1541 is relevant.......
