Defamation suit

One CA filed defamation suit against us because we sent complaints to all PSU Banks against his irregularities. As per IPC 21 CA is also public servant because he is empanel in all PSU bank. Can a public servant file defamation suit? Plz guide process he should follow before filing suit.
