Society president doing maintenance work without any notice

Hello ..

Recently our society has been formed and there are lots of maintenance work going on in society. But our society memebers do not send any notice or they do not take any advice from flat owners. In meeting I told them many times that do not perform any work without owners permission. The work is affecting the maintainance balance. The president is increasing the maintainance without any meeting. Can we take any action against the president?

Regards

No major works can be taken up by Committee without calling a proper meeting, followed by a proper minutes stating the details on resolved decisions. In case, Committee is not taking it seriously you can approach registrar. You can even put RTI to Society through Registrar under section 2(f) of RTI Act 2005.

Majorworks in the name of maintenance cannot be undertaken by the society without a resolution being passed in a meeting to undertake such steps.

If they violate the law or rules, the matter may be taken up through registrar of cooperative societies.

Please let us know the following:

1. In which State are you?

2. Is yours a registered associaion or society? If so under which Act of the State is it registered?

3. Is yours a co-operative housing society or any other type society/association such as say a Flat Owner's Association or any other.

No advice can be given without the above information.
