Cheque related

Hi,

I purchased  flat for 3100000  on 01/01/2012 .While booking the flat I gave 550000 as advance .

After one week ,we made sale of agreement for 500000 as advance and 2600000 through LIC loan.

Builder gave me cheque for 50000 on 07/01/2012 and money credit to my account 0n 10/2/012.

I took the posession by paying the 2600000 through LIC loan on 04/02/2015.

Now builder demanding to pay back him 50000 with out any reason after 3 years. we don't have any document made for the amount 50000 .

is the builder has any liability to demand  50000.

Please help in this case how to proceed.

Regards

Janardhan

In your agreement the role of Rs: 50,000/- does not arise at all because the agreement of sale was made on the basis of advanced amount.

After passing Three Years, Builder don't have any legal right to demand back the said amount whether you  executed any document or not.

you need not to give any reply to the builder.
