My client is a Main Contractor executes works contracts to its consumers and opted to pay Service Tax on 40% of contract with out separating the Supply & Service components. The Contractor also engages Subcontractor/s to execute part of the same contract. Can the Main Contractor claim exemptions for the Service Tax paid to his Subcontractor/s vide Notification no 25/2012 (Sl no. 29 h) or under any other provisions.
