Withdrawal of writ petition

We got all court papers from lower court before 2nd September 2014. A petition was filed in Calcutta High court for police inaction with other allegations. Original case is murder of my younger brother dated on 23rd july 2011. Case is pending for hearing in next month cause list (5th to 30th Jan15). Police filed supplementary charge sheet on 2nd Sept14. My lawyer is asking to withdraw petition. I still want to press the petition. What should be appropriate decision?  

 

2 Attempt went to SC as petitioner in person. Both time dismissed with liberty to move High court.

It is always better to go by your lawyer advice, but what i personally feel is to carry on with the case in high court, as it took 3 years for police to file additional charge sheet after the case was referred to high court, without their intervention the case would have been worse. So let them give a commitment in High court about the proceedings
