Is it necessary to file leave to defend in drc act cases

Dear sir,

A petitioner filed a case u/s 14(1)(e) read with Section 25-B of Delhi Rent Control Act. But the respondent have information in certified form that the petitioner is not an owner of the said property and he is also a trespasser. Hence, the respondent filed an application with all certified proofs under section 151 cpc. In the meanwhile the period of 15 days to file a leave to defend has expired. 

So, kindly tell me  is it necessary to file a leave to defend or not if the petitioner is not an owner/ landlord of the property?

You have an answer in your own question, if you are still not satisfied, better contact your own advocate or a different advocate locally for a second opinion.
