Original land document is missing and the land is encroched

Sirs, my father owned a land in 1986. now he is no more. we just came to know about this land matter and also the land is encroached.  the original land document is not available. but i got certified document from Registrar office and checked that no encumbrance in the land by getting EC . how do we become the owners of the land legally and in what ways? thanks in advance.

File police complaint stating that the Original Document was with you till recently and a few weeks back the said document was missing during the processes of cleaning the house. Obtain copy of complaint and apply for certified copy from Sub Registrar this is enough in the absence of Originals . Now obtain Sucession certificate from court in your name that is over. engage a good lawyer fight for eviction of encroachments

Agreed. You have obtained  certified copy from SRO,the record shows no Encumbrance......................... obtain mutation record from Patwaari, and also inquire the process of getting your name added in mutation records...........................it is simple.............................obtain certified copy of Intkaal from patwaari...................and Nishaandehi by depositing proper fee.............................and thereafter you can take help of your lawyer for disposing the encroachers away from your land, thru police and court of law.
