BORN ON 25/04/1981  AT  ST ANNS  HOSPITAL IN VISAKHAPATANAM

HOSPITAL RECORDS STATE THESE FACTS  ALONG WITH FATHER'S  & MATHER'S NAME

 NAME OF THE CHILD WAS NOT FURNISHED EVEN AFTER 15 YEARS

SCHOOL RECORDS ERRONEOUSLY STATE THE DATE OF BIRTH AS 25/04/1980   ( ONE YEAR  OLDER)

NOT SURE WHETHER HOSPITAL AUTHORITIES  HAVE REGISTERED  THE BIRTH   ( MADUGULA)

 

BIRTH CERTIFICATE WAS DENIED BY THE LOCAL AUTHORITY

HOW TO GET A BIRTH CERTIFICATE -  WITH NAME / 

PL  ADVISE     VERY URGENT     

CAN ANY ONE HELP  AT VISAKHAPATANAM

If the local authority denied to issue the birth certificate on the ground that the birth details were not entered into their  birth register, you get certificate to that effect by making proper application. Then on the strength of the said certificate or report and along with the supporting documents to show your real date of birth, you can approach the court to give suitable direction to the authorities concerned.

I am   now at Hyderabad  -   process has to be done at Viasakahapatanam

There are  other questions  like   if the  hospital has registered tyhe birth  then can a certificate with no name  be obtained ?    they are asking for school certificate which is erroneous -  how they can be compelled to give a certificate of registration / non registration

Which court has to be approached      

Can  the school certificate also be got  corrected I

is it a time consuming process

If any application is made for issuing birth certificate by paying prescribed fee, if any, it is the duty of local authority either to issue birth certificate if entries are available with them or issue certificate stating as such entries are not available.

 

You can approach the Magistrate Court under section 13(3) of the Registration of Birth and Death Act 1969, to direct the local authority to register your birth.


You can also get declaration by filing suit in civil Court along with a prayer of mandatory injunction to correct the mistaken date of birth entered in your educational certificates.

Do you  have any  collegue    practising  in Visakhapatanam    . Can you kindly provide legal help  in this regard .

On line search  was made  to find out the birth registration  .  But no results  found  .  Another effort for a manual search is being  requested  . Please  let us know which are the courts to be approached for this purpose  -

1)  u/s 13(3)  of the Registration of birth Act  

 2) Giving direction to include the name  after 15 years   3) To correct the school leaving certificate  ( also time barred ) .pl help

Name entry in birth records allowed By Express News Service - HYDERABAD Published: 18th August 2013 09:58 AM Last Updated: 18th August 2013 10:11 AM Persons born in the city over 15 years ago and not having their names in the birth registers of the GHMC though they were registered can now have their names entered in the records. The relaxation of rule, which had expired on August 13, 2011, will be in force till December 31, 2014. A large number of parents are approaching the GHMC for inclusion of their children’s names in birth certificates. In particular, professionals settled abroad are seeking inclusion of the names of their wards aged beyond 15 years for Green Card or immigration purpose.Usually, a child’s name is not immediately entered in birth registers as it is customary for Indians to wait for an auspicious day to perform the naming ceremony. Thus, hospitals register only the name of the mother. Hence the missing of the child’s name in records. GHMC officials told Express that in view of the difficulties experienced by citizens, the corporation has urged government to extend the relaxation AP Registration of Births Rules 1999.The deputy registrar-general, New Delhi informed the government that at the time of introduction of the revamped system in 2000, many states made the provision of reckoning the period of 15 years in case of those events which were registered prior to the rules coming into force. In January this year the chief registrar of births and deaths sought permission for allowing entry of the names of children in birth records prior to the period of issue of the AP Registrations of Births and Deaths Rules 1999 for a period period of two years as one-time exception. In view of the above circumstances, the government accorded permission to the chief registrar of births and deaths and the director of public health and family welfare for registering the names of children whose names could not be entered in the birth registers prior to the period of promulgation of AP Registrations of Births and Deaths Rules, 1999. Municipal commissioner MT Krishna Babu said citizens can enrol their wards’ names in birth certificates if they have crossed the age of 15 years.
