I have received summons from Metropolitan Magistrate in a frivolous criminal case on the basis of charge sheet filed in court by the Police.
When can I file Discharge Application ?
Case is a counterblast to another case of Probate of Will Pending before High Court.

There is no stage of discharge in summon case. you have to approach High court U/S 482 of the code of criminal procedure.

I have been advised against approaching High Court because apparently the chances are very less.
On the other hand if I dont do that then I stand trial for upwards of 5 years for a minor charge like calling someone stupid. This is only a way to harass me.
What should be our next step ?

file quashing proceedings before the High court, if court is not inclined, then pray for expidiate the trial...
