validity of stamp paper ?

How long a stamp paper is valid after its purchase date ?

Pls give reference.

Dear Anand,

According to the Supreme Court judgement dated 19/02/2008 in the case of Thiruvengada Pillai Vs Navaneethammal and Anr, THE STAMP PAPERS DO NOT HAVE ANY EXPIRY PERIOD.

Citation: Thiruvengada Pillai Vs Navaneethammal and Anr.

Judgment:

According to a recent Supreme Court judgment dated 19/02/2008 in the case of Thiruvengada Pillai Vs Navaneethammal and Anr, the stamp papers do not have any expiry period. Relevant extract from SC Judgment is reproduced herein below:

"The Indian Stamp Act, 1899 nowhere prescribes any expiry date for use of a stamp paper. Section 54 merely provides that a person possessing a stamp paper for which he has no immediate use (which is not spoiled or rendered unfit or useless), can seek refund of the value thereof by surrendering such stamp paper to the Collector provided it was purchased within the period of six months next preceding the date on which it was so surrendered. The stipulation of the period of six months prescribed in section 54 is only for the purpose of seeking refund of the value of the unused stamp paper, and not for use of the stamp paper. Section 54 does not require the person who has purchased a stamp paper, to use it within six months.

Therefore, there is no impediment for a stamp paper purchased more than six months prior to the proposed date of execution, being used for a document

I have not seen any period of validity both in the Stamp act and stamp rules regarding the validity period of Stamps. Thank you Daksh for the citation.

This issue is time and again discussed. Please check the forums query on the subject. In Maharasthra, the stamp paper should be used within 6 months of its purchase - Section 54 B of the Bombay Stamp Act.

DEAR SIR

CAN ANYONE TELL ME  THE LEGAL VALIDITY OF  AN AGREEMENT TO SALE EXECUTED ON A 10 Rs  STAMP PAPER PURCHAED in THE YEAR 1995  Jan   and execited in Aug 1995 (i.e  stamp paper is purchased 7  Months propr to the date of execution )and  it is NEITHER Noterised nor Registerd has some legal validity in eyes of law in case of dispite for a preumption case the property is worth Rs 3.00 lac in the year 1995

Hi,

If anyone buys the Special Adhesive Stamps and which they have not been used the same for a period of 6 months, are they eligible to claim any refund / reimbursement? If so, what is the timeframe to claim refund? Suppose, if we purchased the Spl Adhesive Stamps and have not been used for a period of 6 months, can we claim refund after a year or two? Else, we need to claim within 6 months of time?

The document is executed on 20.7.2010 and stamp duty is paid on 25.07.2010. what is the validity of the document? is it properly stamped and enforceable?

whether the document executed can be stamped susequently. or will it be a post dated stamped document.?

please  clarify....,
