Can grandson claim equal share from the maternal side property.

Hi Experts,

We have a ancestral property from our maternal side and is about to get sold, Our mother is still alive.

Being grandson/granddaughter weather our signatures for sale agreement and sale deed is necessary?

When your mother is alive, you have no rights over the property.

Grandchildren are not Class 1 legal heirs under Hindu Succession Act. and signature of grandchildren are not necessary for the sale.  Please contact a local advocate for more clarification as your understanding of Ancestral property and applying law maybe not be correct and proper.

Dear Querist,

 

In such a case you are not a legal heir Of your maternal grandfather. Under section 8 of the Hindu succession act, 1956, if a Hindu male dies intestate i.e without a will, then his property is devolved upon his class one heir which includes his mother, wife and children in equal proportion. 

As per the facts given here, your mother will receive the part of her father's property as she is alive. In her absence you will be get her share of the property.

No, you grandson and grand daughter can not claim any share or rights in your maternal side ancestral properties during your mother's lifetime however your mother can claim and her signatures are required.
