Dear sir
DVC maintwnance pending at HC. present no job and income tax returns filed for small amount for last two years. How many years of income tax returns HC may ask husband for finalizing maintenance?

1/3/5 year? or in your history of ITR you are capable of earning so much..so pay accordingly? or Based on present financial condition? pl share opinion.

Dear Querist

As per latest directions issued by Hon'ble Supreme Court of India vide its judgment pronounced in 2020, both parties are required to furnish Affidavits in prescribed format in all maintenance cases along with Income Tax Returns as under:

Whether assessed to income tax?

If yes, submit copies of the Income Tax Returns for the periods given below :

(i) One year prior to marriage
(ii) One year prior to separation
(iii) At the time when the Application for maintenance is filed
