My father has 2 children, me & my sister. We both are married and my father owns a house and a shop. I am not aware about the existence of will but he do not want to transfer his property to me. I have a son so I want to know if me or my son or my wife has any legal right on the property?

During your life time your wife has no right, interest or claim in the property owned /inherited by your father.

You, your sister(s)/ brother(s) and mother has a share in intestate property left behind by your father.

Your son has a claim and right in the ancestral property inherited (but not self-acquired) by your father

If your father executes a will, the property should go to the person named in the will, who is not necessarily related to him or his Class1 legal heirs.
