succession

when one brother and sister is alive even then property can be inherited by legal heirs of Deceased brother and sister as per class II succession act or property will only goes to alive brother and sister

Hello,

In parents property all sons and daughters have equal share as they are legal heirs. If any of the legal heirs is dead then his/her share will go to his/her legal heirs. So in your case legal heirs of deceased son and sister will have share in the property.

but they are mentioned in iv th catagory of class II schedule. I am in confusion when one brother and sister is alive and one dead then how property can be reached in iv the catagory
