Flat possession without completion certificate sddm

Is it safe if i do the flat registration without a cc copy? I made a 2 % registration for under construction flat. Now its ready. I was asking for cc copy to promoter. But he is saying that for upcoming election there is no board in  municipality who will provide cc copy. Plz suggest what to do.

I am sorry that is an administrative decision.  File RTI Application direct to Municipality, provide full details and seek a certified copy of such certificate or copy of such application made by the builder to Municipality.  Facts emerge on such truth of builder's say.

Local norms apply. However, it would always be safe if the conveyance is executed after getting the CC.

Hello,

You are entitled to get the cc copy, the builder cannot refuse it. 

In a nutshell, this document certifies that the building adheres to all the prevailing rules and has not violated any norms. In fact, this document is to be shown compulsorily to the authorities to obtain electricity and water connection.

There is also a provision for a provisional Completion Certificate. When there are minor works left from the developer’s end, authorities provide a provisional certificate valid for six months. After the expiry of the six months, the developer is bound to get a final CC.

Buyers must be aware of the fact that if they are buying or moving into a property which does not have a Completion Certificate, they might be making a risky investment choice. The civic authorities hold power to slap heavy penalties on the developer, leading to stalling or cancellation of the registered layout of the project. In case the building is already occupied, residents may also have to face eviction in extreme cases.

Before you buy a property, it is always advisable to ask for both OC and CC. If the developer fails to provide OC or CC, the next course of action will be dictated by the buyer-seller agreement. If the developer is delaying the availability of OC/CC, you can even ask for rent for that period. The provision of complaining to the authority is always there.

 It is always abetter to be completely  sure of the necessary approvals and essential documents. Precaution is still better than cure.

The following practices are considered as fraudulent in the court of law in case of the real estate sector. A consumer can file a complaint for          

Delayed possession

 Not providing Completion Certificate (CC)  

  Substandard construction quality    

 Construction without attaining requisite approvals

 Construction on unauthorised land

 Fraud in booking of your property      

 Any alteration in land use, layout plan, structures  

Hidden charges

Enhanced External Development Charges (EDC) 

Cancellation of the project    

Forfeiture of the amount  

Hence if not given CC you can approach the Consumer court
