Hi,

According to section 383 of the Indian Penal Code, whoever intentionally puts any person in fear of any injury to that person, or to any other, and thereby dishonestly induces the person so put in fear to deliver to any person any property or valuable security, or anything signed or sealed which may be converted into a valuable security, commits extortion.

Example - A threatens to publish a defamatory libel concerning Z unless Z gives him money. He thus induces Z to give him money. A has committed extortion.

Extortion is a non-bailable offence and triable in any Magistrate. Whoever commits extortion shall be punished with imprisonment of either descripttion for a term which may extend to three years, or with fine, or with both.

Hope this solves your query.

Regards,
Archit.

1. You can file a Police FIR, requesting investigation and charge-sheet, for offences like Extortion, Intimidation, Fraud, Breach of Trust, Mischief etc.... against the person, supported with all relevant supporting Documents, Evidences & Witnesses.

2.  IF the Police does not take action, THEN you can file private criminal case u/s 156(3) Cr.P.C., in the local Magistrates court, seeking directions to the Police to investigate and file charge sheet.  The said Person may come down for settlement.
