is there any immediate arrest in 498a & DV cases ?

41a notice has to be issued to accused.

If you can manage by hook or by crook an Anticipatory Bail..

1. no arrest in DV,

2. apply for the anticipatory bail in 498a

1. Under section 498a, the police will decide whether to arrest the husband and the family members. This is no more a "non-cognizable offence". 

2. File for anticipatory under Cr.Pc section 438. This way if you have the copy from the court of anticipatory bail. police will not be able to arrest you.
