compensation for innocent person

If a innocent person is killed during the tussel between the police officials & dacoits, government is liable to pay compensation to the aggrieved family, please suggest latest supreme court judgement

First make the ball rolling by sending petitions to Supdt of Police, to District Collector and to Ministry of Home affairs.

Search in google for such SC Judgments typing keywords:  Compensation for dependents of innocent victims killed in Police firing.

After all this approach to District Legal Services Authority for free legal aid and further guidance.

Several state governments on their own declare huge compensation during accidents, Thunders, snake bite, flood deaths, fire accidents, rape victims etc though there was no obligation.  If the dead person is not having any criminal cases, and having good conduct, the Government may consider to pay compensation as a special case.  AP state government has given compensation to some villagers who were killed in fights between Naxals and police, but it was voluntary and one can not find such judgments.  Who ever causes injury to others and if the other party suffers, the principle of natural justice is that victim should get compensation.

Just make a try through some sincere social worker advocate who is experienced in Human Rights.

Also file such petition before National Human RIghts Commission.

Presently, it is the norm that the Government is granting compensation in such case. It is a matter of sovereign grace or magnanimity, but not a right.
