Hindu succession act

 My friend's father expired in the year  1993  leaving one house property intestate.  He has wife, four sons and one daughter [i.e.my friend]. Recently my friend's mother executed a partition deed sharing the property in 5 shares i.e. four brothers and one share to herself without providing any share to her daughter.  Pl carify weather daughter is also eligible for the share in the property of her father.

Yes, the daughter is also eligible for the share in the property of her father. The wife, 4 sons and the daughter all have equal share in the property. The daughter can claim her 1/6  share.

Before we analyse the status of shares, we must know  in which community the deceased belonged.The shares are calculated  law prevailing at the time of death .Share calculation of  self acquired property and HUF property  of the deceased are different

what is the staus of second wife and her childrenof a hindu male, when the first wife is alive?

what is the status of second wife and her children of a hindu male , when the first wife is not alive.?

what is the status of a second wife and her children of a hindu male, when the second wife is married after the death of the first wife?

 When the first wife is alive the second marriage of a hindu man is void. The children born out of such marriage are considered as illegitimate. 

If the marriage with the second wife was performed when the first wife was alive,  then the marriage won't become valid on the death of the first wife.

If the marriage with the second wife was performed after the death of the  first wife,  then the marriage is perfectly valid.

You have not mentioned the nature of proerty - Self acquired or Ancestral

If it is Self acquired - wife , Sons and daughter are equally entield to 1/6th share each

If it is ancestral  proerty - the date of death is in  1993 - the daughters entitlement is to be  caicualted under AP HSAct 1986 .Father and sons were only coparceners as on 1993 if the dauther is married beofore the AP amendment  Act - detailed facts required for conclusion

I DIFFER WITH MY FRIENDS IN VIEW OF AMENDMENT TO SUCCESSION ACT S.6 A.P.STATE amendment has lost its existence and succession act being central act  it will prevail over state ACT.How ever in reply to query of MR.RAVISHANKER the division is perfectly valid and your friend has equal share on par with her siblings
