Hindu marriage at bali, indonesia

Dear All,

One of my friend got married in Bali, Indonesia as per Hindu custom and registered as per their regulation..After that boy just gave one fist at India at his home..

India there was no any marrige ceremony and just they went temple (no marriage at temple) and home boy gave, SINDOOR in front of every body..

After wards they stayed abroad for 3 years, no bbay from them and now dispute arises..

Just to check that how India law applicable if they married as per Bali hindu law???

Dear querist,

Hindu marriage act is not applicable in case marriage is happened in Bali.

1. Short title and extent.-(1) This Act may be called the Hindu Marriage Act, 1955. (2) It extends to the whole of India except the State of Jammu and Kashmir, and applies also to Hindus domiciled in the territories to which this Act extends who are outside the said territories.

So in any case they need to for divorce then only Indonesian Civil law will applicable?

You may prefer to file suit for divorce in India, if you want it to be dissolved under the provisions of Hindu Marriage act, 1955, but not in Bali.

Dear Dr. Vashista,

Many thanks for your suggestions.. But our lawers suggested that as marriage was solemnised and registered at Bali, Indonesia so Indian law will not be applicable...Any court matter will only proceed at Bali only..Is it true?

Kindly suggest..
