how to get rid of going to
jail for failing to pay maintainance. as my situation is not good.

These are the circumstances where it would be advisable to go for application under 127 CrPC for alteration of the maintenance amount, but change in circumstances is the soul for invoking the provisions of section 127 CrPC.

To avoid going to jail because of non-payment of the maintenance amount due from you is to get yourself declared insolvant from the court. File petition for insolvancy and get order to avoid jail sentence.
