University law for autonomous college

Sir I would like to know news and laws pertaining to malpractice during Examination in one of the paper and the examination is conducted By an Autonomous body college affiliated to Bangalore University and Coming under purivew University Grant Commission potential college For excellence. The brief note is that a girl student of III year BA in studying in an Autonomous body college in Bangalore had scribbled some Points for memorization on her arm previous night and did not take bathe/cleaned herself and went straight into examination hall next day. She was caught by an invigilator for incriminating note on the body and denied/stopped her to write examination in the first 30 minutes of the commencement. Later her hall ticket was blocked and they did not allow her to take next 4 papers slated for the following days until 20th april. 2017. Despite her ignorance and pleading by parents, the college was too harsh in barring her to take examination and has threatened her that she will be debarred for 2 years after their malpractice committee meet and take decision in first week of May. Is it fair on the part of autonomous body college to restrain a student Who had studied and paid college fee for academic year and examination Fee for university for final degree and just for one silly mistake, the whole Examination degree examnation is restricted from writing and hall ticket Blocked. Kindly highlight the regulation of education system and law pertaining to Malpractice and ways and means of coming out of this vicious circle from Autonomous body colleges in India/Bangalore. Regards Babu Hemant Hagaraj 2

As per university rules

  1. A student may appeal against an order passed by any of the authorized persons to take disciplinary action. An order passed by the Discipline Committee on such appeal shall be final.
  2. An appeal against an original order of the Discipline Committee shall lie to the Syndicate whose decision shall be final.
  3. No appeal under this part shall be entertained unless it is submitted within a period of 15 days from the date of which the appellant receives a copy of the order appealed against, provided that the Appellate Body may entertain the appeal after the expiry of the said period, if it is satisfied that the appellant had sufficient cause for not submitting the appeal in time.

Thanks for your reply sir.  Can Autonomous college restrain the student from appearing remaining balance papers

when they have noticed malpractice in only one paper.  In this case, the student has finished her first day paper,

and caught second day paper.  Still she had another four papers for her to complete.  Since whole academic year

she has studied by going to college, making fee payment, and paying university examiniation fee, is it fair on the

part of autonomoous college to restrain and block hall ticket for all other four papers when they have found only in

one of the paper the malpractice (which was not in this case) and waiting for the Examination committee to give

verdict after finish of the whole examination.  The autonomous college examination manual says the student can

be disallowed to take examiniation on particular day of the examination whereas the admission ticket / hall ticket

issued to the candidate mentions the candidate may be disallowed to take particular paper or all other following

papers or debarred for two years.  Is it not fair on the college part.  is it recognized by law under UGC or State

University affiliation?
