Deemed conveyance - contribution from memebrs

Our CHS located in Mumbai planning for deemed conveyance but there is no sufficient fund in society's account.. Some of our members says that contribution towards legal fees, charges to the lawyer etc are to levied as per flat area of the respective member. While other says that equal all the members should contribute equally irrespective of the area of the flat, because all the members having equal rights in the property of society viz. plot land and building etc. Please Guide
