Warrant against wrong information

Hi All,

A person(Srilankan Citizen) filed a civil case against us and stated that in Court summon that he had gone outside India during the mentioned dates. But when we check his attendance through RTI, there are discrepancies are there between his travel dates and attendance dates. Can we file a criminal case against him for the discrepancies and ask for a warrant against him.

Kindly suggest on this.

Yes you can filed it due to hiding the fact of case with criminal intimadation.

Yes. But why dont you just tell the honourable court where case being fought that he is lying to court on oath. Let him fend for himself.

Mr. Vivek is right.  After place all the record before the Hon'ble Court, you can ask proceeding under sec. 182 of IPC and court will take appropriate action against person for false deposing under oath.

Our tenant(Srilankan Citizen) plan is getting money from us(min 5 L - Max 10 L), that's the reason he filed the Civil case with the help of local goons. He came to India for his higher studies(Doctorate in Tamil).  As the case filed by him is civil case and he is travelling to Srilanka for every month would like to stop the travel, that's y asked for criminal case.
