Society formation

Dear Sir,

I have a flat owned and Builder made a apartment deed and forma condominium. We are total 400 members and out of which 52 members are have apartment deed. Now all other members are willing to do society formation, builder was alos agree but he says collect all 52 original apartment of deed first then and then only we can do something.

I was confused please guide
