Refund of booking amount prior to agreement

I have booked flat (under consrtuction property) with 1 lakh as booking amount . I want to cancel after 1 month due to financial problem .
I have not done the aggrement but i have signed the application form and it has the line as if flat booking cancel then there will be cancellation charges.

Now builder is saying that entire amount will be forfieted (1 lakh)as they have 200 /sqft cancellation charges. But in the document which i have signed there is no line mention cancellation charges of 200/sqft.
Please help me.

Dear Atul u need to give notice to the builder for recovery of one lakh amount.

though there are cancellation charges but WHOLE AMOUNT WILL NEVER BE FORFITED under any law.

If u share the document u sing while booking then we can guide u properly.

There cannot be any unilateral stand in this regard. Any term in contract, involving deprivation of property, could only be through the due process of law.
