Are we conniving with the corruptions in the Judiciary?

No.

That depend upon Advocate to Advocate and person to person. If a headstrong Advocate fights his case for justice to the right client of him, no court can not do anything. Naturally he will become the winner of the case.

With due respect to Mr. Prakash, it is an utopia.

I share concern of Mr. Assumi..The disease is malignanat.

I can foresee a future, where people will stotmed the Courts bashing up the peshkars, dragging the judges and bashing them up and manhandling the advocates. Things re running out of hands.

For every issue it is two sides of a same coin. When positive things happen people will appreiciate. When negetive happens people criticise. Those who do corruption in judiciary they have to face consequences. Upto some level people will wait patiency once they lost patiency, they take law in thier hands. The same judiciary have to face.

Classical example is taking up of arms by Maoists and Naxals. Oppression by police and administration.

N.K.Assumi (Advocate)     28 December 2009

Yes, revolt by the people against the Judiciary may not be so far away!

We are a nation of cowards. We allowed Muslims, Moghuls and the British to rule over us for 1300 years.

Revolt is not in our blood.

Nothing will happen/change; things will go like this, unless and until thinking/attitude or approach of people changes. People of same country are harassing/looting/kiling to their own fellow countrymen just for narrow/temporary gain. Who approaches judiciaries either a weak law abiding perfectionist or people who have to settle score/harass with others.  Maoists /Naxals, Police and Politicians are of same feather and are flocking together in Jharkhand.  Hardcore naxali commander Mr. Kameshwar Baitha is sitting Hon’ble MP from Palamau constituency of Jharkhand on JMM ticket. It is the same JMM which is going to form next govt in Jharkhand.

We are a nation of cunning/ self centered persons of narrow vision. This country has revolted time to time, but due to back stabbers/ leg pullers, each attempt have failed. Still we have strong national force, but anti national forces are outweighing them.  It may be useful to quote the excerpts of history of India.

Kharvela

This incident took place, long, long ago, about 2300 years ago.

Kalinga and Magadha were two powerful states. These neighboring states were at constant war with each other for nearly a century. Kalinga had suffered defeat and was waiting for the right time to teach Magadha a lesson. War had broken out again between them.

Just at that time the King of Kalinga learnt disturbing news, a Greek King had come from beyond India and was marching towards Magadha.

The Magadha had defeated and humiliated the Kalingas’ a hundred years before. Suppose the King of Kalinga had welcomed this attack; suppose he had thought - 'Let this new enemy defeat the King of Magadha, my desire for revenge will be satisfied' – that would have been natural. He could have thought: 'These people of Magadha insulted us a hundred years ago; let them suffer now.'

But the King of Kalinga thought differently. 'This enemy who is now attacking Magadha is an outsider; he comes here to loot. He is as much my enemy as of Magadha.'

Those who had been at war for over a century joined hands in this hour of great danger. The outsider who had come to plunder was driven away.

If only the later kings of India had shown the foresight and wisdom which the King of Kalinga showed twenty-three centuries ago; if only they had sunk their differences when the Muslims and the British attacked our country; if only they had fought united shoulder to shoulder, considering themselves as sons of the same soil; India need not have suffered in slavery.

The king who had acted with such farsightedness and wisdom even in those early days was King Kharavela.

There may be few corrupt persons in the judiciary, but do not drag the entire judicial system on the whole. I hope that 95% of the judges are discharging their duties well. Because May be 5%  We should not loos faith in the judicial system. Why are we blaming the Judges on the whole--- Why is the person who shows intrest in bribing the Judicial officer is not blamed. That if any person is found guilty  of bribing a Judicial officer First his name should be removed from the enrollment list of BAR COUNCIL OF INDIA.  Please dont blame the judges on the whole.

Mr. Sunderaj,

I marvel at your comments. It appears that you have not walked the path that is pebbled with corruption. If you equate the bribery of a peon with that of a Judge, nothing more needs elaboration.

 Ruchika's case.

Incompetence, inefficiency, corruption, influence, bribery or all of them?
