since your grandfathers property is self aquired property and he died intestate the property must have devolved in equal share over his mother,your father,uncle and aunt.your uncle as you told would have relinguished his rights over the property.but since your aunt had not done so her son is entitled to ask for a share in the property as he is legal heir of your aunt.
