Gpa validity

Hello Everyone,

 

A GPA was executed in 2010 for sale of land and was also registered for a time period of 5 years.

Now the owner want to sell this land and tried to contact the GPA holder  but in vain.

He has tried to contact her at her residence and came to know that she no longer lives there.

After attaining evaluation of property document he is assured that the property is still in his name.

 

Now as the GPA has expired and his attempt to contact the GPA holder was unsuccessful my question is:

1)can the owner sell his property.

2)what to do about the GPA document.

2)If the above said property is sold, can the GPA holder raise objection after sale in future and trouble the buyer.

Ans:-Yes.Absolutely.

2)what to do about the GPA document.

Ans:-It is now unenforceable. 

2)If the above said property is sold, can the GPA holder raise objection after sale in future and trouble the buyer.

Ans:No.Never.It is invalid in eye of law now.

Yes principal/owner can sell his properly.After the death of GPA,power of attorney remains not in force and the document is considered as waist paper.GPA holder has no right to challenge principal for his act.
