m a student of law and wish to know what will happen if a summary suit is filed and the defendant has filed his VP after that plaintiff served with summons for judgement but there was delay in filing of reply  to summons for judgement of 16 days pls give suggestion on this and kindly share judgement which help the defendant and allow the condonation of delay.

In Summary Suit Defendant need to file the VP within a period of 10 days from the date of receipt of the writ of summons from the court.

 

In case, the Defendant fails to make the appearance within the 10 days period before the Hon'ble Court, then the Defendant needs to take out Notice of Motion asking for condonation of delay in filing the VP which the court shall allow after levying the costs.
