Indian citizen marrying us citizen in italy

Hi All,

M a software engg, so not knowing much law related things so came here to get some help..

My brother is a indian citizen and is currently working in italy since 1year. He wants to marry an USA citizen girl (not indian) in italy. But we are not sure of the procedure to follow for this ?  If he get married as per ITALIAN civil marrige law, he needs to obtain "atto notorio" (a certificate of no impediment to marrige ) from Italian embassy in india, and "Nulla Osta " (yet another certificate of no impediment to marriage) from the INDIAN consulate in ITALY. 

so my question is :

1. Can we get so called "atto notorio" from italian embassy in india? Hope we can , coz this is to be taken from italian authorities in india

2. Can we get "Nulla Osta" from indian consulate in italy ? Is there any provision of such certificate as per some indian laws ?

3. And above all, will this marrige be valid in india ? or any other procedure is required along with all this ?

4. If all i know is not correct anywhere , then what is the correct way to get married lawfully in italy , when bride is not indian but a US citizen , and Bridegroom is a indian citizen currently living in italy....?

The girl is living and working in US, and just going to italy for marrying him.

Looking forward for some help here in the world of Lawyers....

1.    Marry her under Foreign Marriage Act, 1969 (FMA The Act in short hereafter) in Italy.

2.    Get intended marriage Notice issued upon as per rules mentioned in S. 4 of FMA to appointed Officer at the Indian Consulate General’s office.

3.    Fulfill necessary basic documents which accompanies the Notice.

4.    Pay the requisite Fees.

5.    The intended marriage as per S. 9 FMA may be solemnized any time during office hours of the Marriage Officer or at any other time convenient to him-
(a) at the official house of residence of the Marriage Officer, or
(b) at the office in which the business of the Marriage Officer is transacted, or
(c) at such other place within a reasonable distance from such official house or office as the Marriage Officer may in his discretion approve: Provided that additional fees as specified in Rule 15 shall be payable for the solemnization of any marriage at a place referred to in clause (c).

6.    The marriage Registered under S. 17 FMA before the Indian Counsel General’s office as per procedure mentioned in Form 11 of the Marriage Register.

7.    The Marriage Certificate will be issued under S. 17 (1) FMA by Marriage Officer (Counsel General). This Certificate is valid all over the world including Indian Courts.

Hi Thanks for the reply ..

So this means he does not have to get married in some italian authority as per their law? or any italian law procedure is not required at all to get married in italy for an INDIAN national to marry a US NATIONAL( in ITALY) ....??

1. But if they decide to get married as per italian law, then they need to register their marriage at the Indian Consulate General’s office to make it valid in india?

2. And this procedure is going to take about 1and a half month ?

3. Do the girl need to provide any document regarding her eligibility of getting married  from US authorities ( just like "no objection letter" is required in india in such case) ?
