Who are the successor

Fact:    

1)  A has two husbands.  

2)  First marriage taken place in the year 1964 and 1 daughter From her first husband

3)  First husband died in the year 1969.

4)  she has not inherited any property from her first husband.

5)  Second marriage taken place in the year 1970 and 2 daughters & 2 sons from second husband .

6)  She had no source of income except her seconds husbands' income.

7)  Three properties in her name. purchased in the year 1977, 1982 and 1985.

8)  she died in the year 1998 leaving behind above mentioned 5 children and husband.

 

Q.  For whom the sucession of property is open?

Please Clearify "Children".  Whether Children includes children of  her First Husband or not.

Yes the children of the first husband are also the heirs of the mother. So, all 5 children and the 2nd husband have share in the property.

Those are  properties recorded in her name. So, all her 5 children alongwith her living husband will inherit her said properties.

Whether for point no. 6 Benami Transaction applicable.  

as the property were purchased before 1988
