Company not paid 6 month salary

My Company Sai Infosystem India Ltd. not paid our 6 to 9 month salary. There is more than 1000 employee working who did not recieve there salary. CMD Mr. Sunil kakkd are not gving any statement to us, even they hiding from us. our company located in ahamdabad and I am working in gurgaon. Actually as per my knowledge company take 3-4 big loans from banks and not paid there installment. So company accounts seized by gov.t.

So plese tell me what I have to do to get my salary from company.....?

you need to serve a legal notice to the company through an advocate for asking the dues. you and all your colleagues may file a police complaint for cheating against the company and its directors.

further, after this you may file a summary suit in the court and/or winding up petition of the company with the civil court to recover your dues.

The company has defaulted on loans from banks and as posted by you the a/c’s of the company are seized.

The winding up petition as suggested by Mr. Rohit may be avoided as in case of liquidation of the company the payment of dues of the workmen comes in the last that too pari pasu with bank dues.

Shops and establishments act

Payment of Wages Act

is this a film story or what 

since 6-9 month more than 1000 employees do not get salaries but office is running smootly without any one step to take legal action or what the company is doing 

but about the 1000 employees families doing how are you surviving is a big question or you are hiiding any facts 

if one month salary is not received then no one has a guts to run house for 6 months without salary 

be clear what you are saying in the query

This is aptly put as “is this a film story or what “by Mr. Mahesh.

 

This should happen in fiction only.

 

All affected employees should join hands, form trade union/IC/Guild…………….affiliate with trade unions…………………..and approach their community leaders, govt. CM of Gujarat is easily accessible on govt. portals…………..

 

For their demands have been blocking rails…………………….and their demands have invariably been met.

 

Another querist has stated that 9 months salary is not being paid………….

Incidentally both Maharashtra, Gujarat seems to have granted exemption to IT/ITeS companies from the provisions of Industrial Employment Standing Orders Act, included these industries into public utility services/essential services and barred the employees to strike……………provided exemptions from taxes, duties……………………………………

 

People have been joking that you can start such a company without a penny in your pocket……….. Look at the boasts of the state governments at their web sites…………..

 

 

What is the gain for employees?

Even the wages are not being paid…………………..

 

 

Who shall pay the employees now………………………….

 

MLA’s/MP’s from their funds or CM/PM from their relief funds……………………????????

 

The unpaid wages should qualify to be paid from national Disaster Fund……………………..

 

The lackluster approach, corporate influence,         has only worsened the situation……………..

 

The employees be it 'White Collar' or 'Blue Collar' in today's scenario should be unionized.

 

Employees are a huge vote bank.

 

If united they can drive their interest.

thanks for your suggestion. we fighting for our rights on 4th sept. 13 we register FIR against our CMD Sunil Kakkad and his Brother sameer kakkad (ad. director) at vastrapur police station, ahemadabad, gujarat. We also lodge complaint in all labour court office adn ahemadabad labour court take a action on our complaint, they put stay on CMD's property. 

but problem is that our CMD sunil kakkad missin from 28 June 2013 and company got bankrupt because 2000 crore loan taken by company from SBI and other banks not paid. now nobody in company who can pay us...

police investigating but it will take long time. We are looking for some fast resolution. please suggest what we have to do.....?

The info posted at both then links mentioned by you is perturbing.

You have approached CM and others. Try to meet CM.

The administration should pick up trail and trace the CMD and bring him to court of law.

You have posted that:

labour court take a action on our complaint, they put stay on CMD's property. 

This may not suffice to pay whole debt and taxes. Find out all and rest of the assets of all owners.

Payment of dues of the workmen {WORKMEN} comes in the last that too pari pasu with bank dues.
